New Jersey Readopts Amended Rule
The re-adoption of N.J.A.C. 10:48A, which governs background check requirements for specific agencies, includes new rule N.J.A.C. 10:48A-3.7.
The New Jersey Department of Health published 55 N.J.R. 1830(a), which readopted N.J.A.C. 10:48A and added a new rule (N.J.A.C. 10:48A-3.7). The purpose of N.J.A.C. 10:48A is to establish guidelines for obtaining criminal history background checks of individuals employed with agencies that are under contract with the Division of Developmental Disabilities.
New rule 10:48A-3.7 extends the right to petition for a hearing regarding an individual's criminal history record accuracy with the appropriate state or federal agency or court.
